What are the Bounds of the FCC’s Authority over Broadband Service Providers?

Program Overview:

A spate of recent legal decisions has raised questions regarding the exact boundaries of the Federal Communications Commission’s jurisdiction over broadband communications services. Some argue that the current regime fails to provide the Commission with sufficient legal authority and, as such, the Commission should reclassify broadband as a Title II common carrier service; others maintain that recent court decisions grant the Commission too much authority; and still others view the recent cases as being consistent with well-established case law on the agency’s jurisdiction. Given the Commission’s efforts to move forward with the IP Transition and with its new attempt to draft legally-sustainable Open Internet Rules, clarification of the agency’s authority over broadband services is needed now more than ever. To explore this important and complex topic in detail, please join us for an evening of excellent conversation, good cheer and cigars on the roof of the University Club on Tuesday, June 24th.
